Data controller

Your message

Messages emailed to us are used to understand and respond to your enquiry. First name, surname, email address, subject and message are required to use the form. Without this information, your enquiry cannot be sent. Processing is based on our legitimate interest in responding to enquiries, or on pre-contractual steps requested by you when a possible contract is involved. Responding to an enquiry does not subscribe you to marketing communications. The privacy notice checkbox confirms that you have been informed; it is not consent to marketing.

Current status of the form

The form in this private version allows you to request a reply by email. The browser checks the fields and the server verifies the anti-bot protection before sending the message. The on-screen confirmation means that the sending service has accepted the message; it does not guarantee delivery to the recipient’s inbox. You may also receive an automatic acknowledgement in the language chosen for the form. This does not confirm acceptance of a manuscript or registration for a service. Do not include manuscripts, audio files or sensitive information in your message.

Anti-bot verification

Cloudflare Turnstile protects the form against automated submissions. It may process your IP address, technical information about your browser and connection (including the User-Agent header and TLS fingerprint), the website origin and the widget’s public key. Our code does not send it the text of your message. We use this service on the basis of our legitimate interest in securing the form.

Cloudflare helps protect the website and also processes some signals as an independent controller to improve bot detection. Its privacy policy sets out the arrangements and retention criteria for these signals; its Turnstile addendum does not specify a single retention period. Recipients and service providers

Jean-Christophe Viseur and only those expressly authorised to manage enquiries may access the correspondence. OpenAI hosts ChatGPT Sites under its data processing addendum. Enquiries are received in the contact@editionsducabinetnoir.fr mailbox provided by OVHcloud.

Resend (Plus Five Five, Inc.) delivers messages and acknowledgements. It processes email addresses, email content (including first name, surname, subject and message) and delivery data. Its documentation states that email content and sending logs are retained for 30 days on the Free, Pro and Scale plans, with seven-day backups; remaining data is deleted within 90 days of account termination. These periods are separate from retention of our correspondence in our mailbox. See its personal data information and its data processing addendum. Sending an enquiry does not add you to a marketing list.

Hosting and international transfers

Exclusive storage in France or Europe is not guaranteed. ChatGPT Sites provides for standard contractual clauses or an adequacy decision, depending on the transfer. Resend states that it stores data in the United States and governs transfers through the standard contractual clauses in its addendum. Cloudflare states that it processes data in the United States and the European Economic Area, with possible access from other countries, and publishes its transfer safeguards, including the Data Privacy Framework and standard contractual clauses where applicable. The providers’ documents are linked above. You can request information about these safeguards at contact@editionsducabinetnoir.fr. Details of hosting and mailbox logs and backups must still be clarified before the website opens to the public.

Retention

Routine correspondence is retained for twelve months after the last exchange, then deleted, unless an enquiry remains open or retention is necessary to meet an obligation or defend a legal right. Our procedure provides for monthly checks and manual deletion of expired correspondence from the inbox, sent items, deleted items and working copies. Deletion is not automatic. Contractual and accounting documents are subject to separate retention periods and are not deleted under this rule. Any backups held by providers are subject to their own terms, which remain to be checked.

Telephone callbacks

The optional callback service is separate from sending a message and is disabled in the current version. Before it opens, the French form will identify the professional making the call, the purpose, the duration of the agreement and retention of the evidence. Callbacks will be limited to France and will not be offered on the English form. Declining a callback will not prevent a reply by email. The agreement can be withdrawn at any time and will not cover general campaigns or calls from partners.

Preferences and technical data

The website stores optional reading preferences and some navigation settings in your browser. Previous analytics preferences may still be stored, but they do not trigger tracking while analytics are paused. You can remove this local data in your browser settings. The private proofreading area stores its notes on the user’s device. The hosting provider may process technical connection and security data to operate the service.

Optional website analytics

Metricool website analytics are temporarily paused while we seek clarification from the provider about the requirements applicable in France. No Metricool tracking code is currently loaded on this website. Previously saved browser preferences do not trigger tracking and can be removed in your browser settings.

Manuscripts and artificial intelligence

Submissions are not currently open. Before they are enabled, a separate notice will describe storage, access, retention and any assistance from artificial intelligence. It will identify providers and applicable safeguards; a general acknowledgement checkbox will not replace specific information or separate consent where required. Selection will not be entrusted to a solely automated decision.

Your rights

Subject to the conditions of the GDPR, you have rights of access, rectification, erasure, restriction, objection and, where applicable, portability. You may withdraw consent without affecting the lawfulness of earlier processing. Send your request to the contact address above; proportionate identity verification may be required if there is doubt. The response period is normally one month, with a reasoned extension in the cases provided for by the GDPR.

Information and complaints

You can obtain information and lodge a complaint with the French data protection authority, CNIL, at www.cnil.fr. This reference does not mean that the website is approved or certified by CNIL. This notice follows the transparency principles in Articles 12–14 of the GDPR and will be updated as services develop.
